I am taking someone to small claims court, they claim that my lawyer wrongfully got their banking information by not having a police report. Is this true?

No,
they need a court order.

A police report is not going to help a lawyer get financial information (unless that information is listed in the report).

I will agree with Mr. Goodhi on this one. It would most likely take a court order. A police report is just that, a report of an alleged incident and nothing more.
